Terms of Service

1. Acceptance of Terms

Welcome to MyStaQ. By accessing or using our peptide protocol tracking application ("Service") available at https://MyStaQ.app, you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, you may not use the Service. We reserve the right to update these Terms at any time, and your continued use constitutes acceptance of any changes.

2. Description of Service

MyStaQ is a web-based Progressive Web Application (PWA) that allows users to:

• Create and manage peptide dosing protocols
• Track daily dose completion with a checklist interface
• Manage vials with automatic concentration and draw volume calculations
• View dose history and adherence statistics
• Export data (Premium tier only)

The Service is provided on a freemium subscription model with Free and Premium tiers.

3. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

The Service is not intended for children under 18, and we do not knowingly collect information from minors.

4. Account Registration

4.1 Account Creation

To use the Service, you must create an account by providing:

• A valid email address
• A secure password
• Optional: Your full name

4.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your password
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

4.3 Accurate Information

You agree to provide accurate, current, and complete information and to update it as necessary to maintain its accuracy.

5. Subscription Plans and Billing

5.1 Free Tier

The Free tier includes:

• 1 active protocol
• Up to 2 scheduled doses per protocol
• Up to 2 active vials
• 30-day dose history

5.2 Premium Tier

Premium subscriptions are available at:

• $5.99/month (billed monthly)
• $49/year (billed annually)

Premium tier includes:

• Unlimited protocols
• Unlimited scheduled doses
• Unlimited vials
• Full dose history (unlimited)
• Data export (CSV format)
• Priority support

5.3 Payment Processing

All payments are processed securely through Stripe, Inc. We do not store your full credit card information. By subscribing, you authorize us to charge your payment method on a recurring basis.

5.4 Billing Cycle

• Monthly subscriptions renew on the same day each month
• Annual subscriptions renew on the anniversary of your purchase
• You will be charged at the beginning of each billing cycle
• Failed payments may result in suspension or cancellation of your subscription

5.5 Free Trial

New users may receive a 14-day free trial of the Premium tier. You will not be charged during the trial period. If you do not cancel before the trial ends, you will be automatically charged for the subscription.

6. Cancellation and Refunds

6.1 Cancellation

You may cancel your Premium subscription at any time through your Account Settings or the Stripe Customer Portal. Cancellations take effect at the end of the current billing period.

6.2 Refund Policy

No Refunds: All subscription fees are non-refundable, except as required by law. If you cancel, you will retain access to Premium features until the end of your current billing period.

6.3 Downgrade to Free Tier

When you cancel Premium or are downgraded to the Free tier:

• Your data is not deleted
• You will be restricted to Free tier limits (1 protocol, 2 doses, 2 vials)
• You will not be able to create additional protocols/doses/vials
• Export functionality will be disabled

7. Acceptable Use Policy

You agree NOT to:

• Use the Service for any illegal purpose or in violation of any laws
• Share your account credentials with others
• Attempt to gain unauthorized access to the Service or other users' accounts
• Upload malicious code, viruses, or any harmful software
• Scrape, data-mine, or use automated tools to access the Service without permission
• Reverse engineer, decompile, or attempt to extract the source code
• Use the Service to harm, harass, or impersonate others
• Interfere with or disrupt the integrity or performance of the Service
• Create multiple accounts to bypass Free tier limitations

Violation of this policy may result in immediate termination of your account without refund.

8. Medical Disclaimer

IMPORTANT: MyStaQ is for informational and tracking purposes only. It is NOT a medical device and doesNOT provide:

• Medical advice, diagnosis, or treatment
• Recommendations on which peptides to use
• Dosing recommendations or medical guidance
• Professional health or medical services

You acknowledge that:

• You should always consult a qualified healthcare provider before starting, stopping, or changing any peptide therapy protocol
• We are not responsible for any health outcomes, adverse reactions, or complications resulting from your use of peptides
• The accuracy of dose calculations and vial concentration formulas is provided as-is; you should verify all calculations independently
• You are solely responsible for the safety and legality of the peptides you choose to use

9. Intellectual Property

9.1 Our Ownership

The Service, including all content, features, functionality, design, source code, and trademarks, is owned by MyStaQ and is protected by copyright, trademark, and other intellectual property laws.

9.2 Your Data Ownership

You retain all ownership rights to the data you input into the Service (protocols, doses, vials, notes). By using the Service, you grant us a license to store, process, and display your data as necessary to provide the Service.

9.3 Limited License

We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial use, in accordance with these Terms.

10. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

Key points:

• We do not sell or share your personal data with third parties
• You can export or delete your data at any time
• We comply with GDPR for EU users
• All data is encrypted in transit and at rest

11. Termination

11.1 By You

You may terminate your account at any time by going to Account Settings → Delete Account. This action is permanent and cannot be undone.

11.2 By Us

We reserve the right to suspend or terminate your account if:

• You violate these Terms or our Acceptable Use Policy
• Your account is used for fraudulent or illegal activities
• You create multiple accounts to bypass Free tier limits
• Your payment fails repeatedly
• We cease operations (with 30 days' notice)

11.3 Effect of Termination

Upon termination:

• Your access to the Service will be immediately revoked
• Your data will be permanently deleted within 30 days (backup purge within 90 days)
• No refunds will be issued for unused subscription time
• You may not create a new account without our permission

12. Disclaimers

12.1 "As-Is" Basis

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

12.2 No Guarantee of Accuracy

We do not guarantee that the Service will be error-free, uninterrupted, or secure. Dose calculations and vial concentration formulas are provided as-is; you should independently verify all calculations before use.

12.3 Third-Party Services

The Service relies on third-party providers (Supabase, Stripe, Vercel). We are not responsible for any failures, outages, or data loss caused by these providers.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYSTAQ AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to indemnify, defend, and hold harmless MyStaQ and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any laws or third-party rights
• Any health outcomes or adverse reactions from your use of peptides

15. Dispute Resolution

15.1 Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

15.2 Informal Resolution

Before filing any legal claim, you agree to contact us at support@MyStaQ.app to attempt to resolve the dispute informally.

15.3 Arbitration

Any disputes that cannot be resolved informally will be resolved through binding arbitration in accordance with the American Arbitration Association's rules, rather than in court. You waive your right to a jury trial.

15.4 Class Action Waiver

You agree to resolve disputes on an individual basis only, and waive your right to participate in class actions or class arbitrations.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MyStaQ regarding the Service.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

16.4 Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign our rights and obligations without restriction.

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on this page
• Updating the "Last Updated" date
• Sending you an email notification (for significant changes)

Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service and delete your account.
